Terms & Conditions

These Terms and Conditions apply to the use of elianichols.com and to the coaching, training and speaking services offered by Elia Nichols, Public Speaking & Communication Coach, Florence, Italy (elia@elianichols.com). By using this website or booking a service, you agree to these terms.

1. Services

I offer one-to-one coaching, TEDx and keynote speaker coaching, corporate training and workshops, and speaking engagements. The scope, format, duration and fees of each engagement are confirmed in writing (by email, proposal or agreement) before the work begins. If that written agreement differs from these Terms, the written agreement applies.

2. Discovery calls and bookings

Discovery calls are free and come with no obligation. A booking is confirmed once we have agreed it in writing and, where applicable, the agreed payment or deposit has been received.

3. Fees and payment

Fees are those stated in the written quote or proposal. Payment terms are set out in the quote or on the invoice. Where applicable, VAT is charged in accordance with Italian law.

4. Rescheduling and cancellations

One-to-one sessions can be rescheduled free of charge with at least 24 hours’ notice. Sessions cancelled with less than 24 hours’ notice, or missed without notice, may be charged in full. Cancellation terms for workshops, corporate training and speaking engagements are set out in the individual agreement.

5. Right of withdrawal for consumers

If you are a consumer in the European Union and book a service at a distance (online, by email or by phone), you have the right to withdraw from the contract within 14 days without giving a reason, by letting me know in writing. If you ask me to start the service within those 14 days, you will pay for the part of the service provided before you withdrew, and you lose the right of withdrawal once the service has been fully provided.

6. Your commitment and results

Coaching is a collaborative process, and results depend on your own commitment and practice. While I always do my best to help you reach your goals, I cannot guarantee any specific outcome, such as being selected as a TEDx speaker, getting a job or being admitted to a university. Coaching is not therapy and is not a substitute for medical, psychological, legal or financial advice.

7. Confidentiality

Everything you share with me during our work together is treated as confidential, unless disclosure is required by law. Sessions are only recorded with your consent.

8. Intellectual property

All content on this website and all materials I provide – including worksheets, guides, slides and recordings – belong to Elia Nichols. They are for your personal use only and may not be copied, shared, resold or published without my written permission.

9. Use of the website

The content of this website is provided for general information only and may change without notice. I do my best to keep it accurate and up to date, but I cannot guarantee that it is free of errors. This website may contain links to other websites, which I do not control and am not responsible for.

10. Limitation of liability

To the extent permitted by law, my liability for any claim relating to my services is limited to the fees you paid for the specific service concerned, and I am not liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited by law, including liability for wilful misconduct or gross negligence, or your statutory rights as a consumer.

12. Changes to these Terms

I may update these Terms from time to time. The version published on this page at the time of your booking applies to that booking.

13. Governing law

These Terms are governed by Italian law. Any dispute will be handled by the courts of Florence, Italy, unless consumer protection law gives you the right to bring proceedings in the courts of your country of residence.
